Terms & Conditions of Participation — Male Legacy Weekend

PLEASE READ CAREFULLY. 
Your purchase of tickets and/or participation in The Male Legacy Weekend (“Event”) constitutes your agreement to these Terms & Conditions (“Terms”). If you do not agree, do not purchase tickets or participate in the Event.

By purchasing a ticket online or otherwise registering for the Event, you acknowledge that you have read, understood, and agreed to these Terms electronically. Electronic acceptance is valid and binding under the Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and California law. These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

These Terms should be read in conjunction with our Privacy Policy and Cookie Policy, both of which are incorporated herein by reference.

Definitions

As used in these Terms:

  • “I,” “my,” “you,” and “your” refer to you, the Participant.
  • “BSMDI” refers to Blood Soldiers Men’s Division Inc, its officers, volunteers, agents, representatives, and affiliates.
  • “Event” or “MLW” refers to The Male Legacy Weekend and all associated programs, activities, and facilities.
  • “Minor” refers to any person under the age of 18.
  • “Guardian” refers to a parent or legally authorized guardian executing these Terms on behalf of a Minor.

1. Inspection and Acceptance of Facilities, Services and Programs

In consideration of being permitted to utilize the facilities, services and programs of The Male Legacy Weekend (or for Minors in my care to so participate), I acknowledge and agree, for myself, any participating Minors, and my personal representatives, heirs, and next of kin, that I have inspected and carefully considered — or will immediately upon entering inspect and carefully consider — such premises, facilities, and affiliated programs.

I acknowledge that entry into The Male Legacy Weekend for observation, participation, or use of any facilities or equipment constitutes confirmation that such premises, facilities, and equipment have been inspected and are accepted as reasonably suited for the purpose of such participation by me and any Minors in my care.

2. Participant Health and Physical Condition

By purchasing your ticket(s) and attending The Male Legacy Weekend, you represent that you are in physically sound condition to participate in any physically challenging activities you choose to engage in, and that you are responsible for your own physical well-being throughout the Event.

Each Participant is responsible for their own health-related issues and for notifying BSMDI production staff of any limitations, medications, or physical or mental health conditions prior to admittance to the Event site and facilities. BSMDI may collect certain health and medical information at registration to support your needs during the Event. Such information is handled in accordance with our Privacy Policy, including applicable HIPAA provisions.

3. Assumption of Risk

I understand and acknowledge that I have carefully assessed my own physical, emotional, mental strength, and endurance, and have concluded, after careful deliberation, that I am able to and wish to participate in The Male Legacy Weekend. I understand and acknowledge that there are psychological, emotional, and physical risks associated with participation, and I knowingly and voluntarily assume all such risks.

These risks include, but are not limited to, risks arising from physical activities, interpersonal interactions, outdoor environments, weather conditions, and the nature of the Event programming. I assume these risks whether they arise from the negligence of BSMDI or otherwise, to the fullest extent permitted by applicable law.

4. No Representations or Warranties

I understand and agree that any information provided to me by any person(s) attending The Male Legacy Weekend reflects that individual’s personal experience and opinion only. BSMDI, its officers, agents, employees, and representatives are not and shall not be responsible for any such representations. BSMDI makes no assertions, statements, guarantees, or warranties regarding the contents, outcomes, or results of The Male Legacy Weekend.

5. Release of Liability

I specifically and forever release, waive, and discharge BSMDI from any and all actions, causes of action, obligations, costs, expenses, attorney’s fees, damages, claims, liabilities, and demands of whatever character, nature, and kind, known or unknown, suspected or unsuspected, predictable or unpredictable, arising out of or related directly or indirectly to my participation in The Male Legacy Weekend — whether such injuries, losses, or damages are psychological, physical, emotional, or mental — and I covenant not to sue with respect to the same.

This release applies to the fullest extent permitted by California law. Nothing in this release is intended to limit liability for gross negligence, willful misconduct, or fraud.

6. Indemnification

I agree to indemnify, defend, and hold harmless BSMDI and its officers, volunteers, agents, affiliates, successors, and assigns from and against any and all third-party claims, demands, causes of action, losses, damages, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of or related to: (a) my conduct at or in connection with the Event; (b) my violation of these Terms; (c) my violation of any applicable law or regulation; or (d) any claims arising from my authority — or alleged lack thereof — to execute these Terms on behalf of a Minor.

7. Refund and Cancellation Policy

Participant-Initiated Cancellation

Ticket Refunds are in accordance to our Refund Policy.

If you choose not to attend or to leave the Event early, no refund or credit will be issued for any fees paid or expenses incurred in attending The Male Legacy Weekend, except as described below or required by applicable law.

BSMDI-Initiated Cancellation or Rescheduling

If BSMDI cancels the Event in its entirety and not due to a Force Majeure Event (as defined in Section 8), BSMDI will offer participants a choice of: (a) a full refund of the ticket purchase price, or (b) a partial refund of the ticket price, or (c) a credit toward a future Event. If BSMDI reschedules the Event, participants who cannot attend the rescheduled date may request a refund within 14 days of receiving notice of the rescheduled date, less any applicable fees incurred.

Force Majeure Cancellations

In the event of a cancellation due to circumstances beyond BSMDI’s reasonable control (see Section 8), BSMDI will make commercially reasonable efforts to offer a credit toward a future Event but is not obligated to provide a cash refund unless required by applicable law.

Ejection

If you are asked to leave or ejected from the Event pursuant to Section 10 of these Terms, no refund of any portion of fees paid or expenses incurred will be issued.

8. Force Majeure

BSMDI shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from any cause beyond BSMDI’s reasonable control, including without limitation: acts of God, natural disasters, fire, flood, earthquake, epidemic, pandemic, government orders or restrictions, war, terrorism, labor disputes, venue unavailability, or any other event outside BSMDI’s reasonable control (“Force Majeure Event”).

In the event of a Force Majeure Event, BSMDI will provide notice to registered participants as soon as practicable and will make commercially reasonable efforts to reschedule the Event. BSMDI’s obligations under these Terms will be suspended for the duration of the Force Majeure Event.

9. Permission to End Participation

I understand that I have the unequivocal right, at any point during The Male Legacy Weekend — including during an activity — to end my participation. However, exercising this right does not entitle me to any refund or return of fees paid or expenses incurred, except as provided in Section 7 above.

If I choose to leave the premises, I agree to abide by all applicable rules defined by the specific campground hosting the MLW Event I am attending. Campground rules are available at registration and posted at the Event site. Please contact BSMDI at bloodsoldiers.events@gmail.com prior to the Event for campground-specific information.

10. Right to Eject

I agree not to engage in any conduct that may disturb, disrupt, or prevent BSMDI or other participants from delivering or participating in The Male Legacy Weekend. I understand that my admittance to and participation in the Event is contingent on compliance with this obligation.

In the event I engage in any such conduct, BSMDI reserves the right to instruct me to leave the Event. I agree to comply immediately with any such instruction. BSMDI is hereby granted the authority and right to physically eject me from the Event if I refuse to leave after being so instructed. No refund will be issued in connection with an ejection.

Conduct that may result in ejection includes, but is not limited to: harassment or threatening behavior toward other participants or staff; destruction of property; violation of campground rules; and any conduct that, in BSMDI’s reasonable judgment, poses a safety risk to others.

11. Photographic and Media Release

I hereby grant BSMDI the right and permission to use photographs, video recordings, audio recordings, motion pictures, and any other media (“Images”) taken of me or property in my possession, or of Minors in my care, during the Event, for legitimate promotional and editorial purposes in any media now known or hereafter developed — including print, digital, website, display, and social media.

BSMDI agrees to:

  • Limit use of Images to promotional purposes only
  • Not publish the names of participants alongside any Images without separate written consent
  • Leave any social media “tagging” to the discretion of participants and their guardians

BSMDI retains all copyrights to the Images and any derivative works. This license may be revoked by BSMDI at any time and for any reason.

Consistent with our Privacy Policy and applicable California privacy law, identifiable Images constitute Personal Data. If you wish to request removal of an identifiable Image of yourself or a Minor in your care, please contact bloodsoldiers.events@gmail.com. BSMDI will make commercially reasonable efforts to honor such requests.

12. Minor Participants and Parental / Guardian Consent

The Male Legacy Weekend may include programs or activities in which Minors participate under adult supervision. The following terms apply to all Minors attending the Event:

  • A parent or legally authorized Guardian must execute these Terms on behalf of any Minor participant. This means that in order for family ‘A’ to bring along a minor friend from family ‘B’, the Parent or Guardian of family ‘B’ must sign and agree to these Terms and Conditions of Participation, otherwise the adult in family ‘A’ accepts full responsibility for that Minor.
  • The Guardian warrants that they have full legal authority to bind the Minor to these Terms, including the Release of Liability in Section 5 and the Assumption of Risk in Section 3.
  • The Guardian accepts full responsibility for the Minor’s conduct, safety, and well-being during the Event.
  • BSMDI does not knowingly collect Personal Data from children under the age of 13. Health information provided for Minors is handled in accordance with our Privacy Policy and applicable law.
  • BSMDI staff will not administer medication to Minor participants without express written authorization from the Guardian.

If any claim is brought challenging a Guardian’s authority as represented herein, the Guardian agrees to indemnify and hold harmless BSMDI against all associated claims, demands, damages, costs, and attorney’s fees.

13. Accessibility and Accommodations

BSMDI is committed to ensuring that participants with disabilities or special needs can participate in the Event to the greatest extent possible. If you require an accommodation under the Americans with Disabilities Act (ADA) or have specific physical, medical, or accessibility needs, please notify BSMDI at least 14 days prior to the Event at bloodsoldiers.events@gmail.com so that we may make reasonable arrangements.

14. Code of Conduct

All participants are expected to treat fellow participants, BSMDI volunteers, and Event staff with dignity and respect. The Male Legacy Weekend is a space for personal growth, brotherhood, and community. The following conduct is prohibited:

  • Harassment, intimidation, or threatening behavior of any kind
  • Discrimination based on race, religion, national origin, disability, age, or any other protected characteristic
  • Possession or use of illegal substances on Event premises
  • Destruction of or damage to Event facilities or campground property
  • Recording or photographing other participants without their consent
  • Any conduct that disrupts the Event or endangers the safety of others

Violation of this Code of Conduct may result in immediate ejection from the Event without refund, and may result in legal action where applicable.

15. Governing Law

These Terms are governed by and shall be construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any dispute not subject to arbitration under Section 16 shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and each party consents to personal jurisdiction in such courts.

16. Arbitration and Dispute Resolution

I agree that any claim, controversy, or dispute relating to the enforcement or interpretation of these Terms, or arising out of or relating to my registration, participation, or attendance at The Male Legacy Weekend, shall be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, as amended from time to time. The arbitration shall take place in Los Angeles, California.

By agreeing to arbitration, I waive my right to bring an action before a judge or jury in any court. I understand that I am also waiving rights to discovery and appeal that would otherwise be available in court proceedings. Any award rendered in arbitration may be confirmed as a judgment by any court of competent jurisdiction.

Class Action Waiver. To the fullest extent permitted by law, I agree that any arbitration or proceeding shall be conducted only on an individual basis and not as a class, collective, or representative action. I waive any right to participate in a class action lawsuit or class-wide arbitration with respect to any claim covered by these Terms.

Mass Arbitration. If 25 or more individuals simultaneously submit substantially similar claims, BSMDI and the claimants’ counsel agree to work with AAA to coordinate those claims into a single consolidated proceeding or bellwether process consistent with AAA’s mass arbitration rules and procedures, to the extent applicable.

Exception. Either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending the outcome of arbitration.

If you refuse to submit to arbitration after agreeing to this provision, you may be compelled to arbitrate under the authority of the California Code of Civil Procedure. If any portion of this arbitration clause is found unenforceable, that portion shall be severed and the remainder shall continue in full force and effect.

17. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable under applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions of these Terms shall continue in full force and effect and shall not be affected by the invalid or unenforceable provision.

18. Entire Agreement

These Terms, together with the Privacy Policy and Cookie Policy incorporated herein by reference, constitute the entire agreement between you and BSMDI with respect to your participation in The Male Legacy Weekend. These Terms supersede all prior agreements, representations, and understandings between the parties relating to this subject matter. No representations other than those contained herein have been relied upon by either party.

BSMDI reserves the right to amend these Terms at any time. Material changes will be posted on this page with an updated effective date. Continued participation in or purchase of tickets to any future Event following such posting constitutes acceptance of the revised Terms.

19. Authority to Execute This Agreement

I warrant and represent that I have full legal capacity and authority to enter into these Terms. If executing these Terms on behalf of a Minor, I warrant that I am the Minor’s parent or legally authorized Guardian and have full authority to bind that Minor to all provisions of these Terms, including all representations, releases, waivers, and indemnifications contained herein.

20. Electronic Acceptance and Acknowledgement

By purchasing a ticket to or registering for The Male Legacy Weekend through any online or electronic channel, I acknowledge that:

  • I have carefully read and understand all of the Terms above
  • My electronic acceptance (including clicking “Purchase,” “Register,” or any similar action) constitutes a valid, legally binding signature under the E-SIGN Act and applicable California law
  • I am at least 18 years of age, or I am a Guardian executing these Terms on behalf of a Minor participant
  • I agree to be bound by these Terms without modification

Unless otherwise agreed in writing prior to the commencement of The Male Legacy Weekend, participants may also be asked to confirm their agreement in writing upon arrival at the Event site.
