By using our websites and services, or otherwise by interacting with Us, you consent to this Privacy Policy. Please do not engage in any of these activities if you do not agree with the terms of this Privacy Policy.

Your privacy is important to Us. This Privacy Policy informs you about the information We gather, how We use it, whether We disclose it, and the choices you have regarding Our use of that information. This policy has been updated to reflect current legal requirements, including the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), and modern data protection best practices.

Your use of our website and participation in our events is also governed by our Terms and Conditions of Participation.

1. Information Collected by BSMDI

Content Registration

To access certain content on the Site, you must register with BSMDI. During registration, you provide contact information including your name, address, phone number, and email address. We use this information to contact you about services in which you have expressed interest.

Customer Support

When you contact BSMDI for support related to our Event using any BSMDI-provided support method or portal, We may ask for your name, email address, telephone number, or a ticket number associated with your inquiry.

Forums, Blogs and Testimonials

If you participate in any blog, forum or Testimonial on our website, your user ID or name may be displayed on any content you post and will therefore be visible to the public. You are solely responsible for any liability related to your use of such features.

Correspondence

If you send Us correspondence (email, letter, fax, or phone), We may collect that information into a file specific to you to better track and support your issues. Because BSMDI operates entirely through volunteers, response times may vary. We will make reasonable efforts to respond within a reasonable timeframe.

Mobile User Information

We may receive information from wireless carriers or operators to provision content and data services requested by users. This data is typically limited to cell phone number and, in some cases (such as mobile contest prize fulfillment), a mailing address. Users must explicitly opt in through their carrier or operator before any such information is collected.

Health and Medical Information (HIPPA)

During Event registration, BSMDI may request medical information (including physical conditions, limitations, and daily medication needs) to support your specific needs during your participation in the event. Disclosing this information to BSMDI is optional, and your information may or may not be considered  Protected Health Information (PHI) under HIPAA. For any information that you elect to share voluntarily, BSMDI acts as a Business Associate with respect to such information. PHI is handled in accordance with applicable HIPAA regulations and is shared with on-site medical providers only when necessary for your care. We do not retain medical information.

Sensitive Personal Information

Medical and health data collected through the HIPAA registration process constitutes Sensitive Personal Information under California law. We use Sensitive Personal Information only for the following limited purposes:

  • To provide appropriate health and safety accommodations at our Events
  • To share with on-site medical providers when required for your care
  • To comply with applicable law

We do not sell, share, or use Sensitive Personal Information for purposes beyond those listed above. You have the right to direct Us to limit the use of your Sensitive Personal Information at any time by contacting Us at the address below.

Human Resources / Survey Responses

We collect information when you submit your registration information, respond to occasional participant survey responses, reply to event emails or  updates, or provide similar voluntary information.

Newsletters

If you subscribe to Our newsletters, We use your name and email address to deliver them. You may unsubscribe at any time by following the opt-out instructions in any newsletter or by emailing bloodsoldiers.events@gmail.com.

2. How We Use Information

We may use the data We obtain for the following purposes:

  • Providing the website and services to you
  • Facilitating third-party participation in the provision and improvement of the website and services (including mobile network operators, hosting partners, and analytic service providers)
  • Raising queries with you and responding to issues you raise
  • Communications relating to surveys and customer satisfaction activities
  • Processing job applications and performing applicable checks
  • Verification of personal or business data and payment details before offering services

We do not use personal information for automated decision-making or profiling that produces legal or similarly significant effects without your consent.

3. Data Retention

We retain your Personal Data only for as long as necessary to fulfill the purposes for which it was collected or as required by applicable law. Our general retention practices are:

  • Registration and account information: retained for the duration of your relationship with BSMDI and for up to 3 years thereafter for legal and operational purposes
  • Event-related health/medical information: retained for the duration of the Event and up to 2 years afterward, unless a longer period is required by law
  • Customer support records: retained for up to 2 years from the date of resolution
  • Newsletter subscription data: retained until you unsubscribe
  • Cookies and analytics data: retained per the applicable cookie settings (session cookies expire when your browser closes; persistent cookies typically expire within 12 months)

When Personal Data is no longer required, We securely delete or anonymize it.

4. Service Related Announcements

We will send you service-related announcements when necessary (e.g., if Our service is temporarily suspended for maintenance). These communications are not promotional in nature. If you do not wish to receive them, you may deactivate your account or submit a written request to be removed from our contact list.

5. Customer Service

We communicate with you in response to customer service inquiries, to provide the services you request, and to manage your account.

6. Disclosures and Sharing of Information

We do not sell or rent your Personal Data to third parties for advertising or marketing purposes. The following describes how We may share your information in the normal course of providing Our services:

  • Payment processors (e.g., Stripe.com) — to process your payments. Your data shared with Stripe is governed by Stripe’s Privacy Policy.
  • Hosting and infrastructure providers — to operate and maintain the Site and services
  • Analytics providers (e.g., Google Analytics) — to understand site usage using anonymized, aggregate data only
  • On-site medical providers — only when required for your health and safety during Events
  • BSMDI volunteer staff — limited to those who need access to perform their duties
  • Affiliates — as described below, subject to appropriate safeguards

We do not sell or share Personal Data as defined under CPRA/CCPA without providing the required opt-out mechanism.

Legal Requests & Compliance with Laws

We reserve the right to disclose information as required by law or regulation and when We believe disclosure is necessary to protect Our rights or comply with a judicial proceeding, court order, or legal process. We may disclose Personal Data to governmental authorities when required or reasonably requested to do so.

Disclosure to BSMDI Affiliates

From time to time, BSMDI may share your information with affiliates whose business operations support services provided to BSMDI (such as hosted or transaction solutions). We limit access to Personal Data to only those volunteers and affiliates who need it to provide services to you.

International Data Transfers

BSMDI focuses on processing information from participants located within the United States. Our services are not intended for citizens of the European Union. If your Personal Data has been collected from within the EU, please contact us immediately at bloodsoldiers.events@gmail.com so that we may remove your information from our systems.

To the extent any transfers of Personal Data outside the EU or Switzerland are required, BSMDI will rely on appropriate transfer mechanisms, including the Standard Contractual Clauses adopted by the European Commission (as updated in June 2021 via Decision 2021/914/EU). The 2010 model clauses previously referenced are no longer in use.

Data Processor

As Data Processor, BSMDI processes Personal Data only pursuant to applicable Customer instructions. BSMDI may engage third-party sub-processors (such as Stripe.com for payment processing) in accordance with the purposes identified by the applicable Customer.

Data Controller

As Data Controller, BSMDI owns and controls Personal Data about Our business contacts in accordance with this Privacy Policy.

7. Data Breach Notification

In the event of a data breach that affects your Personal Data, BSMDI will notify affected individuals and applicable regulatory authorities in accordance with applicable law. Notification will be provided within the timeframe required by law (e.g., within 72 hours for GDPR-covered data; within the timeframes required by applicable U.S. state breach notification laws). Notification will include, at minimum:

  • A description of the nature of the breach
  • The categories and approximate number of individuals affected
  • The likely consequences of the breach
  • The measures taken or proposed to address the breach

California Residents (CCPA/CPRA)

  • Right to Delete: You may request that We delete Personal Data We have collected about you, subject to certain exceptions.

  • Right to Opt-Out of Sale or Sharing: You may opt out of the sale or sharing of your Personal Data. We do not currently sell Personal Data; however, you may opt out of any sharing for cross-context behavioral advertising by contacting Us or using the Global Privacy Control signal.
  • Right to Limit Use of Sensitive Personal Information: You may direct Us to limit the use of your Sensitive Personal Information to the purposes listed in Section 1 above.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of these rights.

To exercise any of these rights, submit a verifiable consumer request by emailing bloodsoldiers.events@gmail.com. We will respond within 45 days of receiving a verifiable request (extendable by an additional 45 days when reasonably necessary).

Other U.S. State Residents

Residents of other U.S. states with comprehensive privacy laws (including Virginia, Colorado, Connecticut, Texas, and others) may have similar rights to access, correct, delete, or opt out of the processing of their Personal Data. Please contact Us to make a request.

9. Children's Privacy

Protecting the privacy of children is of utmost importance to BSMDI. The Site is not directed at or intended for children. In accordance with the Children’s Online Privacy Protection Act (COPPA), We do not knowingly collect Personal Data from children under the age of 13. Additionally, in compliance with the California Age-Appropriate Design Code (AADC) and similar state laws, We take additional precautions regarding minors under the age of 18.

If BSMDI learns or is notified that it has collected information from a user under the age of 13, BSMDI will immediately delete such Personal Data. If you believe We have inadvertently collected information from a child, please contact Us immediately.

10. Opt-Out

You may opt out of having your Personal Data used for certain purposes at any time. For example, if you no longer wish to receive Our newsletters or related communications, you may opt out by:

11. De-Identification

BSMDI may de-identify or depersonalize data into anonymized, aggregate data (“Anonymous Data”). Anonymous Data contains no Personal Data or unique identifiers. BSMDI uses Anonymous Data for analytics and may share it with Customers or third parties where contractually permitted.

12. Security

We take appropriate technical and organizational measures to guard against unauthorized or unlawful processing of your Personal Data and against accidental loss, destruction, or damage. These measures include industry-standard practices such as firewalls, restricted access, and encrypted transmissions. We limit access to Personal Data to those persons with a legitimate business need.

However, no company, including BSMDI, can fully eliminate the security risks associated with Personal Data. Due to factors beyond Our control, We cannot guarantee that Personal Data will never be disclosed to third parties.

13. Automated Decision-Making and AI

BSMDI does not currently use automated decision-making processes or artificial intelligence that produce legal or similarly significant effects on you without human review. If We introduce such processes in the future, We will update this Privacy Policy and provide you with appropriate notice and, where required, the ability to opt out or request human review.

14. Third-Party Links and Services

This Privacy Policy does not apply to the practices of companies that BSMDI does not own or control, or to people that BSMDI does not employ or manage. This includes links to other websites on the Site and any companies from whom you may have ordered services or products. BSMDI recommends that you review the privacy policies of any third-party site or service that collects your Personal Data.

15. Changes to this Privacy Policy

We reserve the right to modify this Privacy Policy at any time. If We make material changes, We will post the revised Privacy Policy on the Site and provide notice as appropriate. All such changes will be binding on you 30 days after they are initially posted on the Site, unless you are a new user, in which case they are binding immediately upon your first use.

We encourage you to review this Privacy Policy regularly. The version number and effective date at the top of this document indicate the most current version.

16. Acquisitions

If another company acquires BSMDI or its assets, that company will (a) process the Personal Data held by BSMDI, and (b) assume the rights and obligations regarding such Personal Data described in this Privacy Policy. We will provide notice of any such acquisition to affected individuals as required by applicable law.

17. Disclaimer

We cannot ensure that all of your private communications and other Personal Data will never be disclosed in ways not otherwise described in this Privacy Policy. By way of example, We may be legally compelled to disclose Personal Data, third parties may unlawfully intercept or access transmissions or private communications, or users may misuse Personal Data they collect from the Site.
