These Terms & Conditions of participation was last updated on August 14, 2023. By using our websites and participating in our event and services, or otherwise by interacting with Us, you consent to both our privacy policy (“Privacy Policy”) as well as these Terms and Conditions (“Terms”). Please do not engage in any of these activities if you do not agree with the terms and conditions listed herein. Your privacy and safety is important to Us. The purpose of these Terms and Conditions is to inform you about the information We may gather about you, the risks that may be involved in your participation and all relevant information associated to participation in our event.

DEFINITIONS

The term “I” refers to you, the Participant. The term “your” refers to you, the Participant.

INSPECTION AND ACCEPTANCE OF FACILITIES, SERVICES AND PROGRAMS

In consideration of being permitted to utilize the facilities, services and programs of The Male Legacy Weekend (or for my children to so participate) for any purpose, including, but not limited to observation, use of facilities or equipment or participation in any program affiliated with Blood Soldiers Men’s Division Inc (hereinafter “BSMDI”), I acknowledge and agree, for myself, my participating children and any personal representatives, heirs, and next of kin, that I have inspected and carefully considered, or immediately upon entering or participating will inspect and carefully consider, such premises, facilities and affiliated programs. I acknowledge and agree that entry in The Male Legacy Weekend for observation, participation or use of any facilities or equipment constitutes an acknowledgment that such premises and facilities and equipment therein have been inspected and carefully considered and that I find and accept them as being reasonably suited for the purpose of such observation or use or participation by me, my children, and any minors in my care.

PARTICIPANT’S HEALTH

By purchasing your ticket(s) and attending The Male Legacy Weekend, each participant represents that he is in physically sound condition to participate in any physically challenging activities he chooses in participate in and that he is responsible for his own physical well -being while participating in those activities. Each participant is responsible for his own health-related issues and for notifying the production staff of any limitations, medications, or any other physical or mental ailment prior to admittance to The Male Legacy Weekend site and facilities.

ASSUMPTION OF RISK

I understand and acknowledge that I have carefully assessed my own physical, emotional, mental strength, and endurance, and have, after careful deliberation, concluded that I am able to and wish to participate in The Male Legacy Weekend. I understand and acknowledge that there are psychological, emotional, and even physical risks to me and I knowingly and voluntarily assume all those risks.

NO REPRESENTATIONS OR WARRANTIES

I understand and agree that any information provided to me by any person(s) who attend The Male Legacy Weekend is a matter of their experience and opinion only. I agree that BSMDI, its officers, agents, employees and representatives, are not and shall not be responsible for any representations so made. I understand and agree that BSMDI makes no assertions, statements, guarantees, or warranties regarding the contents of The Male Legacy Weekend.

RELEASE

I specifically and forever release, waive, and discharge BSMDI from any and all actions, causes of action, obligations, costs, expenses, attorney’s fees, damages, causes, claims, liabilities and demands of whatsoever character, nature and kind, known or unknown, suspected or unsuspected, predictable or unpredictable, arising out of or related directly or indirectly to my participation in The Male Legacy Weekend, whether such injuries are psychological, physical, emotional or mental, and I covenant not to sue with respect to same.

ARBITRATION

I agree to have any claim, controversy, or dispute relating to the enforcement or interpretation of this document, or arising or relating to my registration, participation, or attendance at The Male Legacy Weekend, submitted to binding arbitration under the rules and regulations of the American Arbitration Association. The arbitration shall take place in Los Angeles, California. I do hereby waive my right to bring an action before a judge or jury in any court and I understand that I am giving up my rights to discovery and appeal. Any award rendered in any arbitration may be made a judgment by any court of competent jurisdiction. I understand that if I refuse to submit to arbitration after agreeing to this provision, I may be compelled to arbitrate under the authority of the California Code of Civil Procedure.

PERMISSION TO END PARTICIPATION IN THE WEEKEND

I understand that I shall have the unequivocal right at any point in time during the Male Legacy Weekend, even in the middle of an activity, to end my participation in the Weekend. However, under no circumstances will I be entitled to a refund or return of any portion of the fees paid or the expenses I have incurred in attending the Male Legacy Weekend. RIGHT TO EJECT

I agree not to engage in any conduct which may disturb, disrupt or prevent BSMDI or the participants of The Male Legacy Weekend from delivering or participating in The Male Legacy Weekend. I understand and agree that my admittance to and participation in The Male Legacy Weekend is subject to the performance of my obligation not to engage in any such conduct. I understand and agree that, in the event I do engage in any such conduct, BSMDI shall have the right to instruct me to leave The Male Legacy Weekend, and I agree to leave The Male Legacy Weekend if so instructed. I hereby grant BSMDI the authority and the right to eject me from The Male Legacy Weekend if I refuse to leave after being so instructed. If instructed to leave or ejected, I will not be entitled to a refund of any portion of the fees paid or the expenses incurred in attending The Male Legacy Weekend.

PHOTOGRAPHIC RELEASE

I hereby grant BSMDI the absolute and irrevocable right and permission, in respect to any photographs, video tapes, motion pictures, recordings, or any other media (hereinafter collectively known as “Images”) that BSMDI has taken of me or my property, or minors in my care, or in which I may be included with others, to copyright the same, in BSMDI own name or otherwise, to use, re-use, publish, re-publish, post, display, in printed form, or in any and all media now or hereafter known, and for any legitimate purpose whatsoever. You hereby grant to BSMDI the right to use and publish images and photographs taken during your participation in the event to further promote its service via print, web site, display or other appropriate advertisement, and editorial use. BSMDI agrees to limit the use of these images and photographs to promotional use only. BSMDI may revoke this license at any time and for any reason. BSMDI retains all copyrights to the images and derivative works thereof. BSMDI agrees not to publish names of participants along with any images, and will leave any Social Media “tagging” up to the parents.

AUTHORITY TO EXECUTE THIS AGREEMENT

I warrant and represent that, if executing this Agreement on behalf of any participant other than myself, be it a minor child or otherwise, I have full authority to do so and that my purchasing of a ticket and participation in the event with said child is sufficient to bind that participant to all the terms and conditions of this Agreement, including the representations made herein. I agree to indemnify and hold harmless BSMDI against any and all claims, demands, causes of action, obligations, costs, expenses, attorney’s fees, damages and losses should an action be brought that, in whole or in part, challenges my authority as represented herein. This document contains all of the agreements and understanding between the parties and no representations other than those contained herein have been relied upon by any of the parties. I hereby acknowledge that I have carefully read and I understand the terms and conditions of the above Agreement. Unless otherwise agreed to the contrary prior to the commencement of The Male Legacy Weekend, I understand that I may be asked to voluntarily sign this Agreement in its entirety, without change of any kind, at the time that I attend The Male Legacy Weekend.
